Terms of Service

4.1 Monthly Email Processing Limit

• You may process up to 100 emails per calendar month
• Limit resets on the first day of each month at 12:00 AM UTC
• Example: Limit resets January 1, February 1, March 1, etc.

4.2 How the Limit Works

• Each unique email processed counts as 1 toward your monthly limit
• Emails already processed (tracked in our audit logs) do NOT count toward your limit
• If you attempt to process an email we've already categorized, it won't use your quota
• This prevents double-counting and allows you to run categorization multiple times

4.3 Reaching Your Limit

When you reach 100 emails in a calendar month:

• The service will display an error message in the add-on
• No additional emails will be processed until the next month
• Your existing categorized emails remain organized
• You can still access the add-on, but categorization will be paused

4.4 Fair Use Policy

• The 100 email limit is per user, per month
• Attempting to circumvent this limit through multiple accounts or technical means is prohibited and may result in termination
• Excessive API calls or abuse of the service is not permitted
• We reserve the right to implement additional usage restrictions as needed

4.5 Future Changes to Limits

• We may modify usage limits at any time with reasonable notice
• Paid plans (when available) may offer higher limits
• Changes will be communicated via email, in-app notification, or website notice

5.1 Permitted Uses

• ✓ Personal email organization
• ✓ Commercial/business email organization
• ✓ Professional use within the 100 emails/month limit

5.2 Prohibited Uses

You must NOT:

• Violate any applicable laws or regulations
• Attempt to circumvent usage limits or service restrictions
• Abuse, overload, or impair the service
• Reverse engineer, decompile, or disassemble the software
• Access the service through unauthorized automated means (bots, scrapers)
• Process emails you are not authorized to access
• Interfere with other users' use of the service
• Attempt unauthorized access to our systems or infrastructure
• Use the service for illegal activities or spam
• Violate third-party intellectual property, privacy, or other rights

6.1 No Service Guarantees

• EmailCategorizer is provided "AS-IS" and "AS AVAILABLE"
• NO guarantee of uninterrupted, timely, secure, or error-free service
• NO guarantee of specific uptime or availability
• Service may be unavailable due to maintenance, updates, or technical issues
• Third-party dependencies (Google, Cloudflare) may cause interruptions

6.2 Right to Modify Service

• We reserve the right to modify, suspend, or discontinue the service (or any part) at any time without notice
• May introduce new features, change functionality, or remove features
• No obligation to maintain current feature set
• Will make reasonable efforts to notify users of significant changes

6.3 No Support Obligations

• Support provided on a "best effort" basis via our contact form
• No guaranteed response times or support levels
• Support provided at our sole discretion

7.1 Current Pricing

EmailCategorizer is currently FREE to use.

• Free plan includes: 100 emails per month
• No credit card required
• No subscription fees

7.2 Future Paid Plans

We may introduce paid subscription plans or premium features in the future. Potential paid plan benefits may include:

• Higher email processing limits (e.g., 500/month, 1,000/month, unlimited)
• Additional features and functionality
• Priority customer support
• Advanced AI categorization options
• Business/team features

7.3 Pricing Changes

If we introduce paid plans:

• Current users will be notified at least 30 days in advance
• You may choose to upgrade to a paid plan or continue with the free plan
• Free plan may remain available with current or modified limits
• Continued use after pricing introduction constitutes acceptance of new pricing

7.4 Payment Terms (If Applicable)

• All fees in Euros (€) unless otherwise stated
• Payment via methods specified at time of purchase
• No refunds for any fees paid (all sales final)
• Subscription fees non-refundable
• All prices subject to change with notice

7.5 Taxes

• Prices may exclude applicable taxes (VAT, sales tax, etc.)
• You are responsible for all applicable taxes

8.1 Our Rights

• EmailCategorizer software, service, code, design, trademarks, and branding are owned by EmailCategorizer
• Protected by German and international copyright, trademark, and intellectual property laws
• You receive a limited, non-exclusive, non-transferable license to use the service
• License terminates upon violation of these Terms or discontinuation of service

8.2 Your Rights

• You retain all rights to your emails and data
• You own the categorization results
• EmailCategorizer does not claim ownership of your content
• You grant us a limited license to process your data solely to provide the service (as described in our Privacy Policy)

9.1 AI-Powered Categorization

• Uses Cloudflare Workers AI to analyze and categorize emails
• Analyzes metadata: sender, subject, snippet (not full email body)
• Suggests labels based on your existing Gmail labels

9.2 No Accuracy Guarantee

• NO GUARANTEE of 100% accurate categorization
• AI may make errors, misclassifications, or incorrect suggestions
• Should not be relied upon for critical email management without review

9.3 User Control

• You maintain full control to manually recategorize any email
• Emails with low-confidence categorization remain in your inbox
• You can review and modify all categorization decisions in Gmail
• AI is assistive, not autonomous

9.4 No Liability for AI Errors

We are NOT responsible for:

• Incorrect categorization
• Missed important emails
• Mislabeled emails
• Any consequences of AI decisions
• Reliance on AI categorization

You use AI categorization entirely at your own risk.

10.1 Disclaimer of All Warranties

To the maximum extent permitted by German and EU law, we disclaim ALL WARRANTIES, express or implied, including but not limited to:

• NO warranty of merchantability
• NO warranty of fitness for a particular purpose
• NO warranty of non-infringement
• NO warranty of accuracy, reliability, or quality
• NO warranty of uninterrupted or error-free operation
• NO warranty of compatibility
• NO warranty of data integrity or security
• NO warranty of specific results

10.2 What We DO NOT Guarantee

• Service availability or uptime
• Accurate email categorization
• Error-free operation
• Security against all threats
• Compatibility with your specific Gmail configuration
• Preservation of data or emails
• Specific performance levels
• Meeting your expectations or requirements

10.3 Your Responsibility

You use EmailCategorizer entirely at your own risk.

You are solely responsible for:

• Reviewing categorization results
• Ensuring critical emails are properly handled
• Maintaining backups of important emails
• Verifying AI categorization decisions
• Any consequences of using the service

11.1 No Liability Provided

EmailCategorizer provides NO LIABILITY for any damages, losses, or claims of any kind.

11.2 Maximum Liability: €0 (Zero Euros)

Since the service is currently free, our maximum liability is limited to the amount you paid: €0.

If paid features are introduced in the future, our maximum liability is limited to the amount you paid in the 12 months prior to the claim.

11.3 Exclusion of All Damages

To the maximum extent permitted by German and EU law, we are NOT LIABLE for any:

Direct Damages:

• Incorrect email categorization or missed emails
• Loss of emails or data
• Service interruptions or downtime
• Technical errors or bugs
• Security breaches

Indirect/Consequential Damages:

• Loss of profits, revenue, or business opportunities
• Loss of goodwill or reputation
• Business interruption
• Loss of data or information
• Cost of substitute services
• Any other indirect, incidental, special, or consequential damages

11.4 Third-Party Service Failures

We are NOT LIABLE for:

• Google service failures or changes
• Cloudflare service failures or changes
• Any third-party service provider issues
• Internet connectivity problems
• Your hardware or software issues

11.5 Legal Limitation

This limitation of liability applies:

• Whether based on contract, tort, negligence, strict liability, or any other legal theory
• Even if we have been advised of the possibility of such damages
• To the fullest extent permitted by applicable law

11.6 Consumer Rights Preservation

Nothing in these Terms limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under German or EU law

11.7 Your Assumption of Risk

BY USING EMAILCATEGORIZER, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• You assume all risks associated with use of the service
• You are solely responsible for any consequences of using the service
• You will not hold EmailCategorizer liable for any damages or losses

15.1 Termination By You

• You may terminate at any time by uninstalling the EmailCategorizer add-on from your Google Workspace
• Request complete data deletion via our contact form
• Data will be permanently deleted within 30 days (see Privacy Policy)

15.2 Termination By Us

We may suspend or terminate your access to EmailCategorizer at any time, with or without notice, for:

• Violation of these Terms
• Abuse or misuse of the service
• Attempting to circumvent usage limits
• Illegal activity
• Excessive use beyond fair limits
• Any reason at our sole discretion

We have no obligation to provide notice before termination and no refunds will be provided upon termination (if paid features exist).

15.3 Effect of Termination

• Your license to use the service immediately ends
• We may delete your data in accordance with our Privacy Policy
• Sections that should survive termination remain in effect (including disclaimers, limitation of liability, indemnification, and governing law)
